What Happened

A Supreme Court Ruling Just Created a Multi-Billion Dollar Refund Opportunity

On February 20, 2026, the U.S. Supreme Court issued a landmark 6-3 decision ruling that tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unconstitutional finding that the authority to impose tariffs belongs to Congress, not the executive branch.

The ruling immediately invalidated over $166 billion in IEEPA tariff collections. CBP Commissioner Brandon Lord confirmed that approximately $166 billion is owed back to around 330,000 U.S. importers.

Separately, legal challenges to Section 301 China tariffs and Section 232 steel and aluminum tariffs are actively progressing through the courts creating potential recovery opportunities for importers across those programs as well.
